Terms and Conditions

Last updated: October 2026

These terms apply to work carried out by K.O. Property Maintenance, operated by Kyran Oxford (“I”, “me” or “the Contractor”). By accepting a quotation or instructing me to carry out work, you (“the Customer”) agree to the terms below.

1. Quotations and agreed work

1.1. Where appropriate, I will provide a written quotation setting out the agreed work, price and any specific exclusions.

1.2. Quotations are based on the information available and the condition of the property at the time of inspection. If the scope of work changes, or additional work becomes necessary, the price and timescale may change.

1.3. Any additional work or changes to the original specification will be discussed and agreed with the Customer before the additional work is undertaken, wherever reasonably possible.

1.4. Unless expressly included in the quotation, prices do not include additional materials, specialist contractors, permits, structural work, waste removal or remedial work arising from hidden defects.

1.5. Quotations will state how long they remain valid. Work is not booked until the quotation has been accepted and any agreed initial payment has been received.

2. Deposits, materials and payments

2.1. For larger projects, an initial payment may be required to secure the booking and cover agreed advance costs, including materials and special orders. The amount and due date will be stated in the quotation.

2.2. For larger projects, payments may be split into agreed stages, such as an initial payment, one or more payments during the work, and a final balance on completion. The stages, amounts and payment dates will be confirmed in writing before work begins.

2.3. Materials may need to be ordered in advance. Where I purchase materials specifically for the Customer’s project, the Customer is responsible for agreed material costs, subject to their statutory rights and any applicable cancellation rights.

2.4. Unless otherwise agreed in writing, invoices are payable within seven calendar days of the invoice date.

2.5. Any dispute about an invoice should be raised promptly, with details of the amount and reason disputed. Any undisputed balance remains payable in accordance with the agreed payment terms.

2.6. I may pause work if an agreed payment is overdue, after notifying the Customer and allowing a reasonable opportunity to resolve the issue. Any resulting delay to the project will be discussed with the Customer.

2.7. Ownership of materials supplied by me will pass to the Customer once the relevant amount has been paid in full, subject to applicable law.

3. Cancellations, postponements and refunds

3.1. If the Customer wishes to cancel or postpone a job, they should notify me in writing as soon as possible.

3.2. Where a cancellation occurs, I will assess any refund due in accordance with the agreed contract and applicable consumer law. This may take account of work already completed, materials ordered specifically for the project, and reasonable costs already incurred that cannot be recovered.

3.3. Any amount retained following cancellation will be limited to amounts lawfully due. An initial payment will not automatically be treated as non-refundable.

3.4. If I need to cancel a job, I will notify the Customer as soon as reasonably possible. Any refund due for work or services not provided will be dealt with in accordance with the contract and applicable law.

3.5. Customers may have statutory cancellation rights, including a 14-day cancellation period for certain contracts agreed online, by telephone or in the Customer’s home. Where applicable, I will provide the required cancellation information. If the Customer requests that work starts during a statutory cancellation period, any necessary written request and acknowledgement will be obtained.

3.6. Nothing in these terms limits any statutory cancellation, refund or other rights that the Customer may have.

4. Timescales and access

4.1. I will agree an estimated start date and timescale with the Customer. These are estimates unless a fixed date or deadline has been expressly agreed in writing.

4.2. Timescales may be affected by circumstances outside my reasonable control, including delayed materials, adverse weather, hidden defects, changes requested by the Customer or the availability of other trades.

4.3. The Customer must provide safe and reasonable access to the property, together with any agreed parking, utilities and facilities required to carry out the work.

4.4. The Customer should remove or protect personal belongings and valuables from the work area before work begins.

4.5. If access is unavailable, the work area is not ready, or work cannot safely proceed for reasons outside my control, the Customer will be informed and a revised arrangement agreed. Any reasonable additional costs will be discussed before being charged.

5. Existing conditions and unforeseen problems

5.1. Repair, fitting and renovation work can reveal issues that were not visible during the initial inspection, including concealed leaks, damaged materials, rot, uneven surfaces, defective fixings or previous poor workmanship.

5.2. If an unexpected issue affects the work, I will explain the problem and discuss the available options, any additional costs and any likely delay before proceeding with additional work, wherever reasonably possible.

5.3. Work outside the original quotation will not be treated as included unless agreed in writing.

5.4. I cannot guarantee the condition or performance of existing structures, fittings, materials or installations that are outside the agreed scope of work.

6. Materials, products and customer-supplied items

6.1. Materials and products will be selected in accordance with the agreed specification and quotation.

6.2. If the Customer supplies materials, appliances or fittings, the Customer is responsible for ensuring that they are suitable, complete and available when required. I will raise any obvious concerns identified before installation.

6.3. I cannot accept responsibility for defects inherent in customer-supplied products or for delays caused by unsuitable, missing or late-delivered items. This does not exclude responsibility for any damage or loss caused by my own failure to exercise reasonable care and skill.

6.4. Product warranties and manufacturer instructions should be retained by the Customer. Any manufacturer warranty is subject to the manufacturer's own terms.

7. Workmanship, completion and complaints

7.1. I will carry out the agreed work with reasonable care and skill and in accordance with applicable legal requirements.

7.2. On completion, the Customer should inspect the work and raise any concerns as soon as reasonably possible.

7.3. If the Customer believes that work is incomplete or defective, they should contact me in writing with a description of the issue and, where useful, photographs. I will discuss the concern and any appropriate next steps.

7.4. Where work needs to be corrected, I will consider the issue and arrange an appropriate remedy in accordance with my contractual obligations and the Customer’s statutory rights.

7.5. Nothing in these terms removes or restricts the Customer’s rights where services have not been provided in accordance with applicable consumer law.

8. Health, safety and the work area

8.1. I will take reasonable steps to carry out the work safely and manage risks associated with the work under my control.

8.2. The Customer must inform me of any known hazards, access restrictions, relevant property issues or other information that could affect safe working.

8.3. The Customer must keep children, pets and other occupants away from tools, equipment, materials and restricted work areas while work is underway.

8.4. I may stop or postpone work if I reasonably consider the site unsafe, access unsuitable, or conditions inappropriate for the work. I will explain the issue and discuss how work can safely resume.

8.5. Where specialist, regulated or certified work is required, I may recommend that a suitably qualified and appropriately insured specialist is appointed. I will not undertake work outside my competence or any applicable legal requirements.

8.6. Where a project requires other contractors, permissions, building control approval or specialist assessments, the responsibilities and arrangements will be discussed and agreed before the relevant work proceeds.

9. Damage, existing property and waste

9.1. I will take reasonable care to protect the work area and the Customer’s property while carrying out the agreed work.

9.2. The Customer should tell me about fragile items, concealed services, known defects or other relevant risks before work begins.

9.3. Any accidental damage or concern arising during the work should be reported promptly so it can be assessed and addressed appropriately.

9.4. Removal and disposal of waste, packaging, old fittings and surplus materials are included only where stated in the quotation. Any additional waste removal arrangements or charges will be agreed in advance.

10. Insurance and responsibility

10.1. I will maintain any insurance required by law and any other insurance represented as being held by the business.

10.2. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.

10.3. Subject to the above, responsibility for loss or damage will be assessed in accordance with the contract and applicable law.

11. Complaints and resolving disputes

11.1. If the Customer has a concern, they should contact me first so that I have a reasonable opportunity to understand and resolve the matter.

11.2. Both parties will make reasonable efforts to resolve disagreements through clear communication and by sharing relevant information.

11.3. These terms are governed by the law applicable in England and Wales, and any dispute will be dealt with by the appropriate courts, subject to applicable consumer protections.

12. General

12.1. The written quotation, any agreed changes and these terms form the basis of the agreement between the parties.

12.2. If any part of these terms is found to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

12.3. These terms do not remove any rights the Customer has under applicable law.
